This is the user agreement between us 'Stimulation Ltd' and 'you' the user and will govern your use of our web site together with the laws of England.

Please take time to read these terms and conditions it is important for both of us that you understand our contractual relationship relating to your use of this web site and our services.

Any booking made or order placed by you, whether through the web site or otherwise, shall be deemed an offer by you to purchase the relevant items subject to these conditions.

The Company will only accept a booking upon receipt of written confirmation, by letter, e-mail or fax, and once this is received a contract shall have been made. Until the booking deposit is paid, the Company shall be free to offer the date in question to other interested parties.

We operate as an agency. This means that we may act as a disclosed agent for third party suppliers, such as tour operators, hotels or restaurants. What this means is that the contract for the product is between you and the supplier.

In most cases this will mean that there are additional terms and conditions governing the contract, as each supplier will have terms and conditions relating to that product. Please make sure that you have read our terms and conditions before completing your transaction with us.

Where we act as agent this will mean that we have no contractual liability to you in respect of that product. However, we may still be liable to you if we have been negligent, we have misrepresented important information or have been in breach of any other relevant law. On the other hand, for some products, we act as principal. This means that the contract for the product is between you and us. Don't worry we will let you know where we act as principal and where we act as agent before the point of booking.

Because the contract for the product is between you and the supplier any queries or concerns relating to the product should be addressed to them.

We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However there may be times when obvious errors occur. For example, very occasionally, this may result in a price, product or service or other detail displayed being incorrect. In this case we reserve the right to cancel that contract, but this of course will be without any liability to you.

Stimulation Ltd does not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.

Legal Terms and Conditions

Ownership, copyright and trade marks
The content of this web site belongs exclusively to Stimulation Ltd. Unauthorised use is strictly prohibited. All title, ownership rights and intellectual property rights, including copyright, rest with Stimulation Ltd. If any photograph is submitted to the site or company, Stimulation Ltd reserves the right to publish this information.

Accuracy of information and limitation of liability
Stimulation Ltd and its suppliers have taken all reasonable care that the content of this web site is correct and publishes such information in good faith. As user you acknowledge and accept that:

· travel service providers such as airlines and hotels are requested and encouraged to correct and update their information regularly and as needed and that Stimulation Ltd will not be responsible for errors, omissions or misleading information in travel information and listings supplied by third parties; and

· to the maximum extent permitted by applicable law, Stimulation Ltd will not be liable to you under any circumstances for any loss or damage arising from your using of, or reliance on this web site, including any service or facility that it provides.

No warranties
To the maximum extent permitted by applicable law, Stimulation Ltd grants no warranties, express or implied, regarding this web site. The site and any service or facility are being offered to you 'as is'. The Stimulation Ltd will not be liable to you for the breach of any alleged warranty.

Indemnity
As a condition of your use of this web site including any service or facility, you agree to indemnify Stimulation Ltd from and against any liability, damage or loss that Stimulation Ltd incurs or suffers as a result of any action, inaction or omission on your part.

Liability
You accept financial responsibility for all transactions made under your name or account.
In order to make a purchase you must be over 18 years old and have the legal capacity to make the transaction.
You must make sure that all the information you provide to us is true and accurate.
You must not use the website for speculative, false or fraudulent bookings.
The transmission of threatening, defamatory, pornographic, political or racist material or any material that is otherwise unlawful is expressly prohibited.
The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you, except if you wish to make copies of the website for your own personal and non-commercial use.

Damage or Loss
You accept liability to pay in full for any damage or loss to the equipment, transport or clothing supplied by us arising out of a negligent act or omission of you or your Guests. Stimulation reserves the right to exclude any guest who is deemed to be wearing inappropriate clothing or footwear from participating in any of the activities during the event.

You and every Guest agree to limit any claims against the Company to the risks and amounts insured against by the company and agree to observe the terms and conditions thereof. We accept no responsibility in respect of any damage whatsoever, to your property or the property of your guests except where such damage is caused by our negligence.

You and your guests agree to indemnify Stimulation Ltd or it's partners against all actions, claims, costs, expenses and demands in respect of death or injury you or your Guests, arising out of or in connection with attendance at the contracted event in circumstances where we are not at fault.


Financial Terms and Conditions

Payment
Where your contract is not with Stimulation Ltd but with a third party supplier such as a tour operator or hotel, we may pass your credit card (or details of any other payment method allowed) and any other essential booking details to that third party. The placing of an order for any goods and services by you will constitute consent to us passing on such details.

You undertake to us that the details you give to us are correct in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service.

If there are any changes to the details supplied to us by you it is your responsibility to inform us as soon as possible.

Fares
Fares are subject to change without prior notice and are only guaranteed when following confirmation of the contract.

Cancellation / Refunds / Amendments of flight tickets
If you need to change or cancel your travel plans, it is your responsibility to notify Stimulation Ltd in writing of such request. Some flight tickets are non-refundable and some tickets do not allow changes.
If you already have been issued with your flight ticket please return them to us. Tickets must be sent to: Stimulation Ltd, 1 Wye Street, London SW11 2SN. We will attempt to recover costs on your behalf.
Flight tickets that are refundable or cancelled by us will be processed and refunded back to you in approximately 6 weeks from our receipt of the ticket. Some tickets may need to be submitted to the airline for the cancellation and/or refund to be authorized. In this event your refund request may take longer, but we will advise you of the expected turnaround period.
Please note that most airlines do not refund on part used tickets. Tickets that are returned more than 1 year from date of issue are classified as expired tickets and must be submitted to the airline for their authority to refund.

Lost Tickets
If you lose your flight tickets, it may be possible to re-issue them for a fee. The amount payable will depend on the circumstances of the loss and how close to the travel date you discover it. However, not all tickets can be re-issued; which is another good reason for ensuring you have sufficient insurance cover. Tickets will be dispatched to you in accordance with your instructions and we accept no responsibility for their delivery. Lost tickets that cannot be re-issued are refunded at the sole discretion of the airline; these refunds can take up to one year to be authorized.

The Contract Price
For adventures, hen and stag parties and team building services you agree to pay a booking deposit at the time of booking and the remaining balance prior to the event. We will inform you of the deposit required and date of balance at the time of booking.
Any charges for extras incurred requested by you during an event will be invoiced after the event and are due for payment not later than 14 days from the invoice date.

Cancellation Charges
Where practicable we will endeavour to recoup cost on your behalf. Should a full refund be possible from our third party suppliers, we will endeavour to secure this for you. However, for our own protection cancellation charges will apply from point of booking. We will inform you of cancellation charges at the time of booking.
Attractive terms and conditions can be negotiated with existing and regular clients.

Reduction of number of Guests
Where practicable we will endeavour to recoup cost on your behalf. Should a full refund be possible from our third party suppliers, we will endeavour to secure this for you. However, for our own protection the cancellation charges apply from point of booking and we will inform you of what these are at the point of booking.


Product Specific Terms and Conditions

Flights
Note that Stimulation Ltd are selling the tickets as agents for the airlines, which means the contract for the flight product will be between you and the airline.
A contract arises between you and the airline when we send you a confirmation e-mail on behalf of our third party partners confirming that they have accepted your booking.
Please be aware that most airlines also have a penalty or cancellation fee for any changes or cancellations to fares. Please ensure you read the FLIGHT RULES for the fare selected as airline charges are notified in those rules depending on whether you wish to cancel or change your flight. If you are holding a booking for which a ticket has been arranged and you do not notify us in writing of your desire to cancel, this will be treated as a "no show" and could result in you losing all that you paid.
You are responsible for complying with any airline's terms in relation to check-in times, reconfirmation of flights or other matters. In relation to flight tickets, you are required to use all flight coupons in order of sequence. If this requirement is not met the airline may void the ticket.

Flight Reservations
Be aware that certain airlines do not maintain 'real time' seat availability in the airline reservations system to which we connect. Whilst every effort is made to reflect the true situation, instances may occur when airlines cancel sales. We will advise if this is the case and will do all we can to reinstate your booking.

Flight Reconfirmation
Unless we advise you to reconfirm the first flight out of the U.K there is no need to do so. All onward and return flights must be reconfirmed with the relevant airlines at least 72 hours prior to the start of that leg of the journey unless specifically informed otherwise by that airline. Stimulation Ltd accepts no responsibility for bookings cancelled due to non-compliance with rules set by that particular airline. We also take no responsibility for any flight rescheduling en route.

Unreasonable behaviour
If in the reasonable opinion of a person acting in authority you are not fit to travel, he or she may refuse to let you board the aircraft. Normally this happens if such person thinks you are likely to disturb or harm other passengers. In this case your contract with us and our third party suppliers will end immediately and we will no longer be responsible for you.


Team building and Adventures
Please note that because the contract for the adventure or team-building products is between you and the supplier, we have no discretion in deciding whether the product can be cancelled or modified.
Please note, some of our adventure products are sold 'subject to availability' what this means is that we do not confirm your order immediately but we will pass your details onto our suppliers who will check to see if the adventure is available, if it is they will book it for you, if it's not they will revert to us to contact you.


Other travel related issues

Passports/Visas/Health Requirements
It is your responsibility to ensure that you meet the passport, visa, health requirements of the countries you wish to visit and those that you transit (even if it is for a plane change). Many countries require that your passport should be valid for a period of (a minimum) six months from the date of arrival into that country. Stimulation Ltd do not accept any responsibility if you should be denied boarding or deported due to non-fulfillment of the above.

Insurance
Stimulation Ltd strongly urges you to carry appropriate travel insurance to cover you for cancellation, health, baggage etc.

Safety Issues
You and all your guests agree to abide and comply with any request or order made by or on the behalf of Stimulation Ltd on the grounds of safety.
You and all your guests agree that the opinion of Stimulation Ltd or its partners and agents is final in regard to any matters appertaining to safety i.e. All non swimmers will be required to wear a life jacket whilst onboard the boats and you and each and every Guest agrees to abide by such opinion howsoever expressed.

If in the opinion of Stimulation Ltd or its partners and agents you or any of your guests are behaving dangerously or is acting in a manner which would or may, in our opinion, lead to a disruption of the services at the contracted event or endanger any person we reserve the right to leave the event for the rest of the day contracted for, without encountering any liability.

Any additions or alterations of the terms and conditions of this agreement shall be null and void unless agreed upon in writing by the parties.
